A lawsuit seeking court confirmation that its ‘Crispaw’ dog toy doesn’t infringe Cristal Champagne trademarks was dismissed after the plaintiff stopped pursuing the case.

VIP Products LLC hasn’t submitted filings in the case since Judge Susan R. Bolton said she would dismiss the suit if VIP didn’t properly notify Champagne Louis Roederer SA of the case. Bolton’s delivered on her ultimatum requiring VIP to “show good cause” for its failure to serve Louis Roederer after setting a seven day deadline on Sept. 19, according to a filing in the US District Court for the District of Arizona.
